Save'ena - Weekend Excursion - Part 7: Tribunal - Findings

Sav, dressed in her Cadet Formal Whites, was sitting at the defendants desk with her assigned Defense Lawyer, Ensign Gabin Dubois, and her student Advisor Captain Bayushi Kachiko, Marine. Sav kept herself still, trying to keep her fears tamped down to a manageable level. This all had happened a week earlier, and still affected her a week later. However, this time, was the findings of the Tribunal and what was to happen with her, and with powerful exclusive clubs and powerful men involved, she was sure she was going to get the 'hammer'.

At the other desk facing the area where the three high ranking flag officers would be sitting was the Prosecution desk. At it sat a Lieutenant Commander JAG Officer with the two Senior Cadets, Josh Reslynn and Jon Kennedy, who had been wounded on the weekend excursion. While Jon seemed to be at ease and waiting to get back to his life, Josh was definitely showing signs of being nervous and waiting judgement, similar to Sav.

Sav thought about her defense lawyer while briefly glancing at him. Ensign Dubois was semi-nervous, but still looking forward to what the verdict was. He was still waiting for his first win as a defence JAG. And, with the evidence Cadet Tillatix's advisor had come up with, this case may result in that first win.

Sav shifted and felt the presence of the person on her right. Kachiko had been fighting for her so much, and Sav did not know what she could do to repay her student advisor who had taken such and interest in a girl from a back water world. Sav was at a loss for words. She glanced at Kachiko, smiling gratefully.

Kachiko felt the Cadet's emotional roller coaster and remained looking forward, sensing the Panel's approach.

A Lieutenant Aide stood up and called the Tribunal to order. Sav stood up and waited. Three Admirals came into the room, two Rear Admiral's and one Vice Admiral. The Aide called out, "Rear Admiral Torenson, Rear Admiral Clinton, and Vice Admiral Byrd presiding." The three admirals were seated and the aide called out, "At ease, you may be seated."

Sav kept an inward smile from showing upon her face. Just as Kachiko had predicted, Vice Admiral Lempkins must have recused himself. She did not say anything, though, as the tribunal findings session was underway. What she did not know was that Vice Admiral Robert Byrd was a top 'fellow' member of the exclusive Magnata Gentleman's club.

Rear Admiral Torenson spoke out, "I am calling this Tribunal Judgement to order. This is not a court martial or other JAG judiciary court proceeding. In the case of Star Fleet Academy versus Cadet Tillatix, this is a judgement of preponderance of evidence for allowance of Cadet Tillatix to remain at the academy and any proceedings of findings of those accused of Tillatix during these findings."

He picked up the Padd with the findings upon them. He spoke out, "All rise."

Sav stood up, now facing towards the Admirals bench. Gone was any fear or trembling as she now stood there, willing herself to show force of will of who she was, while waiting for the judgement to be laid against her. She fought to be herself for four long months in a brain washing dungeon, so she could be here for herself at this tribunal.

Sav 'heard' Kachiko in her head very briefly, "~Calm, doll. You will be alright. ~"

Rear Admiral Torenson read the following, "Upon review of the evidence, there were many a coincedence and anomoly surrounding the events which led up to the incident between Cadet Tillatix and Cadets Reslynn and Kennedy. There was more happening that either side has brought forth and shown. Therefore, by benefit of a doubt, Cadet Tillatix is found not at fault of any issues surrounding the events leading to her wounding Cadets Reslynn and Kennedy." Rear Admiral Torenson paused to allow reactions to what he read and let those reactions fade so he could continue.

Ensign Dubois smiled broadly as his charge was actually found not at fault. He glanced over to Sav and Kachiko, then brought his eyes back front to see what charges would be leveled at the two Senior Cadets in question.

At the prosecution bench, Josh was now astonished and fearful, whild Jon was still very much at ease. He whispered to Josh to settle down, while Lt. Cmdr Timbor LaSade motioned for them to stay still and not disrespect the Tribunal session.

Sav had a wondering look on her face. She was found not at fault, not at fault, just like she should not be. She kept her eyes forward, but did not manage to stop her tail from shifting right a little to brush against Kachiko as a show of thankfulness for her being there and doing what she could for Sav.

Kachiko made no outward show of emotion, remaining as stone-faced as a Vulcan.

Rear Admiral Torenson continued reading, "To continue: Due to the incongruencies surrounding this case, and lack of collaboration of the other first year cadets involved, Cadet Reslynn and Cadet Kennedy are also found not at fault of any untowardness towards Cadet Tillatix or the other Cadets in question." Once again, Torenson paused so reactions could be gotten under control.

Lt. Cmdr LeSade smiled and nodded to his two charges. Josh was wide eyed and astonished, while Jon had a smirk upon his face as he whispered to Josh, "Told ya."

Ensign Dubois deflated a little bit. There went his win for this case. Still, it was his first draw, and also his first charge to not be convicted, so he could feel proud about the way this went.

Sav jerked lightly as this news hit her. Then she settled, her feelings fleeing as she assumed a full waiting to see what else was going to occur. That the Seniors got away with it, and would do it again, was known to her from the start. Such was the way it always was.

Rear Admiral Torenson held up a hand to show more information coming. He now continued to read from the Padd. "However, while not enough to warrant prosecution, there was enough disparate evidence and incongruencies found to authorize that for the next three years, all activities and sponsored events by the Plutocrat Seniors Club will be monitored and have an Advisor Chaparone present for those activities, such monitoring only to be stopped upon meeting the full standards as put forth by the Starfleet Academy Standards for outings."

A small smile passed across Sav's face. She had expected the Seniors to have gotten off scott free. To be monitored for at least three years was a small victory for those who would be victims and to tamper down the club's activities. While things could be setup for bypassing that monitoring, with Kachiko's superiors involved, that would not be likely. Sav felt justified for having fought and for what had been achieved.

Kachiko allowed a small smile to cross her pale lips. The investigation was far far from over. Vice Admiral Chen had taken a personal interest in the activities of the several disparate clubs and what senior Starfleet officials were engaged in there.

Rear Admiral Torenson continued, "Now onto the final ruling. There is the small mater of the scuffle between Cadet Tillatix and Cadets Reslynn and Kennedy. The crux is this, Cadets cannot be wounding Cadets, even if thinking justified. While the Tribunal believes there was some tomfoolery happening, nothing is in the evidence that would warrant such protective measures as possibly killing another cadet by a cadet, even if that cadet has natural weapons and instincts. Therefore, it is ordered by the Tribunal that Cadet Tillatix be remanded to Counseling for initial evaluation, and then she must take an Anger Management Class along with a Self-Control Class. She will remain enlisted at the Academy during that time. At the end of those classes, Counseling will create a scenario to test her understanding and training, and then assess if Cadet Tillatix is officer material for Starfleet and to remain in the Academy, or to be Section eight outed. Her initial counseling session will be 0900 hours on October 2nd. That is all."

At the prosecution table, Jon fist pumped for having gotten the Senior's intitial offering to Cadet Tillatix to happen, their way of revenge for having their weekend of fun lost. Josh had an apologetic look to his face. He had hoped that would not have happened, but realized that the reasons for it by the Tribunal made sense. Lt. Cmdr LeSade glanced sharply at the two to let them know to settle down, they were still in session.

Ensign Dubois looked taken aback, but then settled into what was said. It could have been worse, Cadet Tillatix could have been drummed right out for being considered not able to control herself and her instincts of protection. At least this way, she had a chance.

"I would like to register an official objection, sirs," Kachiko stood now, conspicuous in her pitch black uniform. "As a rare individual with a license to kill, I understand more than most that all citizens, including the cadet, have a natural right of self-defense, up to and including the use of lethal force."

Vice Admiral Byrd motioned to the other two he would handle this. He spoke to Kachiko, "Captain Bayushi, your official objection is so noted and registered. However, in all the preponderance of evidence, at no time was the life of Cadet Tillatix or the lives of the other first year cadets at risk. With no risk to lives, the cut along Cadet Reslynn's thigh came perilously close to his femoral artery, and even in this day and age, out in the woods as they were could have resulted in Cadet's Reslynn's death. Therefore, the rulings stands as needed to make sure Cadet Tillatix will not be a danger to others about her during duty and off duty situations not involving potential loss of personal life. That is all."

As everyone was on their feet already for listening to the ruling, the Aide called out, "Please remain standing." The Admiral's left the tribunal desk. After they were gone, the Aid called out, "All parties, Dismissed."

At the prosecution table, Lt. Cmdr LeSade spoke sharply to Cadet Kennedy. "You need to keep yourself more in check. I don't care who your family is, got it?" Jon snorted and said, "Yeah, yeah, I will."

As this was happening, Josh was looking towards the Defense table. Having caught Sav's eye, he did a small wave and mouthed, "Sorry." Sav did a small wave back with a nod of her muzzle. From Josh's actions during the trial, she felt he was okay. The other Cadet, not so much.

Before the Prosecutor and the two Seniors left, Kachiko stepped over, her voice sharp and her eyes hard, "Cadet Kennedy, attention!"

An expression of 'WTH' came over the cadet, but he came to attention and looked sharply at Kachiko, responding with a "Sir?"

When the Cadet was standing stiff as a board, the Marine continued, "When a superior officer tells you not to do something, boy, you bloody damned well click your damned heels together and respond with a 'Sir Yes Sir'!"

"If you don't get your act in order, boy, I will make your remaining time at the academy a world of shit, regardless of whom your father is. Am I understood!?"

Cadet Jon Kennedy made a face, but as he had already been told off by Lt. Cmdr LeSade, and now Captain Bayushi, he said, "Yeah, understood, Sir"

Lt. Cmdr LeSade almost growled out, but held his tongue. When would this boy learn? He spoke to the two, "We are out of here, now." The three left.

Kachiko just shook her head and returned to Sav and Dubois.

Ensign Dubois turned to his charge and her advisor. "That went better than expected. Their club will be under monitoring for the next three years, and Cadet Tillatix wasn't arbitrarily dismissed from the Academy for causing bodily harm to those two cadets. All in all, not a win, but a draw and a chance for Cadet Tillatix to remain at the Academy." He reached out a hand.

Sav felt anger rise, but tampered it down. In how he put it, he was right. She was still there. All she had to do was get through two perscribed classes, and she would remain at the Academy. Of course, no freaking way for any more sponsored outings. She would remain true to her classes, and being a wingman for Rina when Rina felt the urge to go out. She took his hand into hers and gave it a shake, saying, "Thank you."

He left, as well as the Admiral's Aide. It was just Kachiko and Sav left in the room. Sav's ears and nose showed she was sensing the room, then she stepped forward to give Kachiko a hug. She whispered, "Thank you.. thank you so much for everything you did for me."

Kachiko offered the much taller Mephetian a brief embrace, "You and the other cadets in my care are my only concern, hon. Don't worry about the rest. Vice Admiral Chen will be continuing that investigation while I focus on you and your fellow classmates."

"You'll be fine. Those classes are nothing, trust me, I've been there," Kachiko shrugged.

Sav churred slightly, "I have been through much worse, Kachiko. An evaluation and two classes will be almost a walk in the park. I can handle that, no problem. I am just happy I was found without fault, as it should be, and am still in the Academy."

"Always a silver lining," Kachiko said.

Sav churr laughed, then responded, "Yeah, finally, a silver lining for me. Thanks."

"Just avoid Cadet Kennedy for now. From what I could glean from the evidence and his very confused and loud thinking, Cadet Reslynn had little idea what the others were intending on doing."

"I will still be monitoring them both along with the other Seniors involved. I just don't feel that you will make it through another incident involving that overgrown child."

Sav paused for a moment in thought. She now asked, "But, he is a Senior Cadet. Shouldn't he be past childish thinking and be onto understanding of adult reality?"

"Sav, Cadet Kennedy is not yet matured into adulthood. He has been protected from consequences for his actions by his father," Kachiko motioned toward the door. "Some humans just never find maturity."

Sav shook her head as she turned and headed out of the room. Such a waste of potential was upon her mindset. She responded, "Such a shame he cannot see his actions and their affect upon others. I would hope to never be attached to his command.... L'Tandrey protocol would never allow such." She sighed, then asked Kachiko, "Will I find commitment and duty among those I would consider peers? I... I... that duty is all I have that is me... Can I find duty, commitment, and understanding as a cadet?"

"He may see his actions but just plain doesn't care," Kachiko sighed. "He won't get far in the fleet if he doesn't pull his head out of his ass."

Sav nodded, and replied, "I would hope that would be the case." She churred softly, "Again, thank you, Kachiko. I will be at the cadet counselor's building at 0845 hours to find out who will be doing my eval at 9:00."

"Good," the diminutive Marine said as the pair exited out into the San Francisco fog. "I can accompany you to your first session, if you want?"
